1. Service Description
BC Site Design provides AI-powered voice agent services including automated call answering, call routing, lead qualification, and message taking (“the Service”).
The Service is provided “as-is.” Customer acknowledges that AI technology has inherent limitations and may not handle all calls perfectly, capture all information accurately, or route calls correctly in every instance.
2. Subscription & Payment
- Monthly subscription fee as specified at checkout
- 12-month minimum commitment required
- Billed automatically each month; all fees non-refundable
- Early termination requires payment of remaining balance as a termination fee
- After initial term, continues month-to-month until canceled with 30 days notice
3. Usage & Overages
- 900 minutes included per month (connection to termination)
- Unused minutes do not roll over
- Overages billed at $0.25 per minute
- Overage charges will be invoiced separately as one-time charges to the card on file
- Failure to complete payment within 15 days may result in service suspension or termination
4. Service Availability
BC Site Design does not guarantee 100% uptime, call answer rates, AI accuracy, or successful transfers. Service disruptions or AI errors do not entitle Customer to refunds or credits.
5. Customer Responsibilities
Customer agrees to:
- Provide accurate business information and approve configurations before deployment
- Notify BC Site Design of changes to business hours, services, or contacts
- Comply with all applicable call recording and telephony laws
- Inform callers of AI interaction and call recording as required by law
6. Data
- Calls may be recorded; Customer owns all call data
- BC Site Design may use anonymized data for service improvement
- Data retained 90 days; deleted within 30 days of termination upon request
7. Limitation of Liability
BC SITE DESIGN’S TOTAL LIABILITY SHALL NOT EXCEED FEES PAID IN THE THREE MONTHS PRECEDING ANY CLAIM. BC SITE DESIGN IS NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST REVENUE, MISSED CALLS, AI ERRORS, FAILED TRANSFERS, OR INACCURATE INFORMATION PROVIDED BY THE AI.
CUSTOMER ASSUMES ALL RISK ASSOCIATED WITH AI TECHNOLOGY LIMITATIONS.
8. Indemnification
Customer agrees to indemnify BC Site Design against any claims arising from Customer’s use of the Service, including claims by callers, failure to obtain required consents, or violation of applicable law.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF AI RESPONSES.
10. General Terms
- Third Parties: Service relies on third-party providers; BC Site Design is not liable for their failures
- Modifications: Terms may be updated with 30 days notice; continued use constitutes acceptance
- Acceptable Use: Service may not be used for unlawful purposes; violations may result in immediate termination without refund
- Governing Law: State of Maryland; disputes resolved in Maryland courts
- Entire Agreement: This agreement supersedes all prior communications
